This notice explains how James Ramsden KC ("I", "me") collects, uses and protects personal information. I am a self-employed barrister practising under the name The Office of James Ramsden KC, and I am the data controller for the personal information described in this notice.

Whose information this notice covers

This notice applies to:

  • people who visit this website
  • people who contact me with an enquiry
  • clients, including people who instruct me directly under the Public Access scheme
  • solicitors and other professionals who instruct me
  • other people whose information I receive in the course of my work, such as opposing parties, witnesses, experts and other people involved in a matter

What information I collect

If you visit the website: This website does not use analytics, advertising or tracking cookies. The website's hosting provider may collect limited technical information, such as your IP address and browser type, for security and to keep the site running.

If you contact me: your name, contact details, and anything you include in your message. Please do not send confidential information about a matter until you have been asked to.

If you instruct me, or I act in a matter involving you: the information needed to provide legal services. Depending on the matter, this may include:

  • personal details
  • financial information
  • information about business interests and assets
  • correspondence
  • documents relevant to the case

It may also include special category data (for example, information about health, religious beliefs or ethnicity) and information about criminal convictions or allegations, where this is relevant to the matter.

How I use your information

I use personal information to:

  • respond to enquiries and decide whether I can accept instructions
  • carry out conflict checks
  • provide legal advice and representation, including preparing for and appearing in court or tribunal proceedings
  • keep records and manage my practice, including billing and accounts
  • meet my legal and regulatory obligations, including anti-money laundering checks, professional conduct obligations and responding to complaints
  • investigate or deal with complaints, legal claims, or reports to my insurers or regulators
  • carry out training, and publish reported cases or legal commentary where the information is already public or has been anonymised

Legal basis for using your information

I rely on the following lawful bases under the UK General Data Protection Regulation (UK GDPR):

  • Contract: where processing is needed to provide legal services to you, or to take steps at your request before instructing me.
  • Legal obligation: where I must process information to comply with the law or my regulatory duties.
  • Legitimate interests: where processing is needed for my legitimate interests in running my practice and providing legal services, and those interests are not overridden by your rights. This includes processing information about people other than my client in the course of a matter.
  • Consent: in the limited cases where I ask for it. You can withdraw consent at any time.

For special category data and criminal offence data, I rely mainly on the processing being necessary to establish, exercise or defend legal claims, or for the purpose of obtaining legal advice, as permitted by Article 9(2)(f) UK GDPR and Schedule 1 to the Data Protection Act 2018.

Who I share your information with

I only share personal information where it is necessary for the purposes above. Depending on the matter, this may include:

  • people who support me in my practice, such as clerks or administrative staff
  • instructing solicitors, other barristers, and pupils or mini-pupils working with me
  • courts, tribunals, arbitral bodies and mediators
  • opposing parties and their legal representatives
  • experts, witnesses and other professional advisers
  • regulators, including the Bar Standards Board, and the Legal Ombudsman
  • my professional indemnity insurers
  • providers of IT, email, document storage and website hosting services
  • my accountants and auditors
  • law enforcement or other authorities, where required by law

I do not sell personal information, and I do not use it for marketing without consent.

International transfers

Some of the service providers I use may store or process information outside the UK. Where this happens, I make sure appropriate safeguards are in place, as required by UK data protection law.

How long I keep your information

I keep personal information only for as long as necessary for the purposes it was collected for. That includes meeting legal, regulatory, accounting and insurance requirements.

Case files and related records are kept for a period that reflects the time limits for bringing legal claims and the requirements of my professional indemnity insurers. They may be kept longer where there is a good reason, such as a matter involving a minor, a continuing dispute, or a regulatory requirement. Enquiries that do not lead to instructions are deleted once they are no longer needed.

Keeping your information secure

I use appropriate technical and organisational measures to protect personal information. These include secure, access-controlled systems, encryption where appropriate, and confidentiality obligations on anyone who works with me.

Your rights

Under data protection law, you have the right to:

  • ask for a copy of the personal information I hold about you
  • ask me to correct inaccurate information
  • ask me to delete your information
  • ask me to restrict how I use your information
  • object to processing based on legitimate interests
  • ask for your information to be transferred to another organisation
  • withdraw consent, where I am relying on it

Some of these rights are limited. For example, I may not be able to share or delete information that is protected by legal professional privilege, or that I must keep to meet legal or regulatory obligations. If an exemption applies, I will tell you.

To make a request, please contact me using the details above. I will respond within one month.

Complaints

If you are unhappy with how I have handled your personal information, please contact me first so I can try to put it right.

You also have the right to complain to the Information Commissioner's Office:
